AGARTALA, India, May 16 -- Tripura High Court issued the following order/judgement on April 13:

1. Learned Senior Counsel, Mr. P. Roy Barman assisted by Learned Counsel, Mr. S. Bhattacharjee is present on behalf of the applicants.

Learned Advocate General, Mr. S. Chakraborty assisted by Learned Counsel, Ms. Pinky Chakraborty is present for the respondents.

Taking part in the hearing, Learned Senior Counsel, Mr. P. Roy Barman drawn the attention of the Court that against notification dated 15.07.2022 (Annexure-1) the present applicants and other applied and out of 230 posts 29 posts were UR, 29 for SC and 172 posts were reserved for ST.

Challenging that notification, certain persons filed one writ petition before this Court and against the judgment of the writ petition, some appeals were preferred, bearing No.W.A. No.458 of 2020, W.A. No.460 of 2020 along with W.P.(C) 736 of 2022 and the Division Bench of this High Court by a judgment dated 19.12.2022 disposed of those appeals and the writ petition with the following observation. For the sake of convenience, relevant para no.34.1 of the said judgment is mentioned herein below:

34.1 Directions in WP(C) 736 of 2022

(i) The employment notification dated 15.07.2022, issued by the Member Secretary, Teachers Recruitment Board, Tripura (TRBT), for filling up the posts of 'Graduate Teacher' for the Classes-IX-X, wherein, 201 posts have been kept reserved out of 230 posts, is also interfered with to the extent that the number of vacancies carried forward shall not be given effect to.

(ii) The selection of reserved category candidates must be limited to 50% for filling up the total number of posts of 'Graduate Teacher' under the notification dated 15.07.2022. The respondents shall prepare the select list following the said ceiling limit of 50% rule for reservation.

(iii) The official respondents shall not apply the carry forward rule in any of the future recruitment process for filling up the vacant posts of 'Graduate Teacher'.

Challenging that judgment the State also preferred a revision petition, bearing Revision Petition No.9 of 2023 which was also dismissed by order dated 04.04.2023.

After that the State of Tripura preferred one SLP (Civil) Diary No.32678 of 2023 (Annexure-13) and the Hon'ble Supreme Court by order dated 22.04.2024 passed an order that the "statusquo with respect to appointment be maintained." In the meantime, according to Learned Senior Counsel, the State further issued another notification on 29.08.2025 (Annexure-15) and by the said notification 700 posts have been advertised for selection as Graduate Teachers (STGT) and out of 700 posts 364 are UR, 119 are SC and ST 217.
