NAINITAL, India, March 23 -- Uttarakhand High Court issued the following judgment/order on Feb. 20:

1. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.05 of 2026 under Section 8/21 of the Narcotic Drugs and Psychotropic Substances Act, Police Station Nanakmatta, District Udham Singh Nagar.

2. Heard Ms. Sarita Bisht, learned counsel for the applicant and Mr. Chittrarth Kandpal, learned Brief Holder for the State.

3. Learned counsel for the applicant submits that the recovery from the applicant is of 20.10 gram of smack (heroin), which is below the commercial quantity; applicant has no criminal history; there is no independent witness.

4. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.

5. Accordingly, bail application is allowed. Let the Applicant-Harvinder be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court subject to the condition that the Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
