NAINITAL, India, March 23 -- Uttarakhand High Court issued the following judgment/order on Feb. 20:
1. The present Bail Application has been moved by the Applicant-Bhupendra Singh, who is in judicial custody in connection with Case Crime No.22 of 2025, registered at Police Station Thalisain, District Pauri Garhwal, under Sections 8/20/29 of the N.D.P.S. Act, 1985.
2. Heard Mr. Utkarsh Tiwari, learned counsel (through V.C.) for the Applicant and Mr. Chittrarth Kandpal, learned Brief Holder for the State, and perused the record.
3. Learned counsel for the Applicant submits that the Applicant has been falsely implicated solely on the basis of the confessional statement of co-accused Kapil Kumar, from whose possession the alleged recovery has been made by the police. The Applicant is in judicial custody since 02.10.2025. It is further submitted coaccused Shivam has already been released on bail by this Court vide order dated 14.01.2026 and applicant is also entitled to be released on bail on the ground of parity.
4. Learned Brief Holder for the State has opposed the bail application.
5. Considering the facts and circumstances of the case, and without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant deserves to be released on bail at this stage.
6. Accordingly, bail application is allowed. Let the Applicant-Bhupendra Singh be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
